Yes. Hemp-derived CBD with no more than 0.3% delta-9 THC remains legal in Texas under both state and federal law. The big change is who can buy it: you must be 21 or older, and a valid government-issued photo ID is required.

• THCA now counts. Under DSHS rules effective March 31, 2026, the 0.3% limit is measured as total THC, which includes THCA.

• Smokable hemp is in flux. Rules on smokable hemp flower have been tied up in court, so this guide focuses on non-smokable CBD.

Products are also labeled by type. Full-spectrum contains CBD plus other cannabinoids and trace THC. Broad-spectrum removes most THC. Isolate is CBD only. If you're sensitive to THC or get drug tested, isolate is the lowest-risk choice, since full-spectrum products can trigger a positive THC result.
Congress redefined hemp in late 2025. The restrictions on naturally derived hemp THC products are now scheduled for December 11, 2026 (delayed from November 12). The new standard counts total THC and caps finished hemp products at 0.4 milligrams per container. That can affect full-spectrum CBD even when its THC percentage is low, while CBD isolate is generally expected to be less affected. Rules may change again before then, so ask us what's currently in stock before you plan a big order.
